| Ardmay House International Summer School Terms and Conditions Ardmay House International Summer School (“AHISS”) is a trading style of Ardmay Limited a company registered in Scotland under company number SC211698 Ardmay House, Arrochar, Argyll, G83 7AH (“Ardmay Ltd”) By making an application to enroll their child (“the Student”) in AHISS, the parent or guardian who has signed the application form (“the Parent”) accepts that they shall be bound by these Terms and Conditions and Course Rules. By enrolling in AHISS the Student agrees to comply with the Course Rules for the duration of the course, and at any time they are under the care and supervision of AHISS staff. Booking and Deposit It is advised that you make your booking as early as possible as places on the course are strictly limited. Confirmation of a booking is at the sole discretion of AHISS and is subject to payment of a deposit of £300, and to availability of places on the selected course. AHISS reserves the right to refuse any application and in this event will return or refund any deposit paid. Fees By 1 June or at the time of booking (whichever is earlier), the Parent shall pay the course fee of in full. The Student will not be admitted to AHISS, under any circumstances until the course fee has been paid in full. Not Included in the Course Fee Transport to and from your home city, pocket money and souvenirs, travel insurance, health insurance and medical expenses, or airport transfers outwith timeframes and airport stated in the travel arrangements section of this document. Included in the Course Fee Accommodation, full board, 15 hours/week English tuition, adventure activities and excursions, course materials, 24 hour supervision, laundry and airport transfers if student arrives within stated timeframes and at specified airport. Payment All payments should be made in pounds sterling to Ardmay Limited. The balance of fees is payable by 1st June. Any bookings made after 1st June must be paid in full at the time of booking. Cancellation All cancellations must be made in writing and take effect from the date we receive such notice. The deposit is non-refundable. Cancellation charges are applied according to the amount of written notice we receive as follows: 61+ days Deposit £300 31 – 60 days 50% of total cost 0 – 30 days 100% of total cost Application By making an application, the Parent agrees that: 1. They have read and accepted the terms and conditions and have read and accept, and undertake that the Student will abide by, the Course Rules; 2. All information supplied in connection with the application is accurate, complete and true and they will inform AHISS of any changes to such information, in particular of; a)any new, or change to an existing medical condition which is relevant to the ability of AHISS to cater for and look after the Student; and b)the contact details of the parent/guardian; 3. The Parent or another person who has legal responsibility for the Student will be contactable on the telephone numbers given on the application form throughout the Student’s time travelling to, attending and returning from the relevant course; 4. No other person’s consent is required for the Student to attend the course. Course Descriptions AHISS intends to run the relevant course in accordance with the descriptions it has most recently published on its website, but reserves the right to make any amendments to the courses at its absolute discretion and in such a manner as it considers appropriate; Programme Changes The details of the programme have been published in good faith. AHISS reserves the right to make any changes or alterations to any aspect of the course, in the event of unsuitable weather conditions or other factors beyond our control. Eligibility AHISS is open to students of all nationalities aged between 8-16 years old. All those who require a visa in order to take part in a course are responsible for obtaining the relevant visa and travel documentation. Promotional materials At the direction of the Course Director, photographs or videos may be taken of the students on the course. The Parent and Student hereby consent to AHISS using these photographs or video clips as part of future AHISS promotional material unless the Parent or the Student notifies AHISS to the contrary of writing. The Student and the Parent will be asked to fill out an end of course questionnaire. The Parent and the Student hereby consent to AHISS using this material in future promotions, unless the Parent or the Student notifies AHISS to the contrary in writing. Copyright in any such photographs or video clips shall become the property of Ardmay Ltd. Visiting a student The Parent may visit the Student during a course if they have made a prior arrangement with the Course Director at least 24 hours in advance. If the Student is to be taken out of organised activities (including lessons) or out of the care and responsibility of a member of staff, the Parent must provide written permission by signing an AHISS absence form. Travel Arrangements The Student’s travel arrangements to and from AHISS need to be confirmed to AHISS in writing as soon as possible after booking as do any changes that may occur. The cost of excess baggage is entirely the responsibility of the Student and AHISS will not pay this charge under any circumstances. Please check the airline’s baggage policy before travelling. All students arriving and departing from Glasgow International Airport on the dates stated below will be transferred to and from AHISS free of charge as long as students arrive within the departure time of AHISS coaches. AHISS must receive all flight/travel information by 1st June. Please do not book open tickets: purchase a return ticket on the stated arrival and departure dates. Arrival dates: Sunday 8th July, Sunday 15th July, Sunday 22nd July, Sunday 29th July, Sunday 5th August 2012. Departure dates: Saturday 14th July, Saturday 21st July, Saturday 28th July, Saturday 4th August, Saturday 11th August 2012 Visas A valid passport is essential for travel to the UK with an expiry date of at least 6 months beyond the end date of the Student’s visit. The Parent is responsible for arranging appropriate travel documentation, such as visas, where required. Upon receipt of the full course fee, we are able to provide a letter of confirmation to you containing: - The full name and date of birth of the Student, with passport number if provided - The start and finish dates of the course and the full address of the school where your child will be staying - Confirmation that the course fees have been paid in full and include full residential accommodation, airport transfers, 15 hours of English lessons per week and an organised social and activity programme. - Our ABLS accreditation number. Insurance The Parent must ensure that that the Student has comprehensive travel and medical insurance sufficient to covers the entire duration of the Student’s trip. Details of insurances must be sent to AHISS by 1st June (or at the time of booking) so AHISS can satisfy itself that the Student is covered appropriately for their stay. AHISS is not responsible for any deficiencies in your insurance policy. AHISS reserves the right to refuse admission on any course if evidence of insurance has not been provided. Admission to a course does not imply that the Student’s insurance cover is appropriate and the responsibility for obtaining and maintaining comprehensive and adequate insurance lies with the Parent at all times. Medical The Parent is responsible for informing AHISS on application of all medical, dental, dietary, educational or other special needs regarding the Student. All costs related to those needs including medical and dental care, tests, allergy, shots and prescriptions are the responsibility of the Parent. The Student will be sent a medical form on acceptance to the program on which they must inform us of the student’s Health Insurance carrier. All bills from health facilities used by AHISS on behalf of the student will be sent to the Parent. Students from the European Union should carry a valid European Health Insurance Card. Liability Ardmay Ltd. will exercise due care in arranging and conducting the course. However, we cannot assume responsibility or liability for any damage, loss, claim or injury of any kind whatsoever resulting from any act of omission, commission or inadvertence of any carrier or other company or person rendering any of the services required as part of the course. Nor can Ardmay Ltd. be responsible for any student who leaves the course (with or without consent) or who breaks the rules and regulations and in doing so suffers loss or injury. The parent/guardian shall keep, save, hold, defend and indemmify AHISS and will keep AHISS indemnified against any claims, costs, proceedings, demands, losses, damages, expenses or liability whatsoever arising as a result of any breach of the contract or violation of the course rules by the Parent or the Student; To the maximum extent permitted by law, Ardmay Ltd. excludes liability for any loss or damage of any kind however arising, including, without limitation, any direct, indirect or consequential monetary or other loss suffered by a Parent or student as a result of the student taking part in one of Ardmay Ltd.’s courses but if Ardmay Ltd. is held by a Scottish court to be directly responsible for any such loss or damage, we will pay to the parent/guardian or student who has suffered loss up to the amount equal to the price paid to Ardmay Ltd. for the relevant course. Ardmay Ltd. has public liability Insurance. Nothing in these terms and conditions shall exclude any liability of Ardmay Ltd. for death or personal injury arising from its own negligence or that of its employees nor affect any rights which the parent/guardian or student have as consumers. Force Majeure Ardmay Ltd. will not assume responsibility or liability for any damage, loss, claim or injury (including claims for its failure to run the relevant course) resulting from events beyond its control including, without limitation, acts of God, strikes, incidents of terrorism, politically or religiously motivated violence, war, sickness, government restrictions or regulations, weather, quarantines or willful or negligent acts of third parties or suppliers to Ardmay Ltd.. Entire Agreement and Variation These terms and conditions contain the whole agreement between AHISS and the parent/guardian in relation to all aspects of the course. In particular, no statements, understandings, agreements or warranties made orally or in writing, on the website, in the brochure or elsewhere shall have any relevance to these terms and conditions. Any changes to these terms and conditions will only have effect if made in writing and signed by both parties. These terms and conditions supersede all previous agreements, arrangements and understandings but nothing herein shall be read or construed as excluding liability resulting from any fraudulent act or omission by any party. Assignation These terms and conditions and all rights under them may be assigned or transferred by AHISS but not by the Parent. Jurisdiction These terms and conditions shall be governed by Scots law and the parties submit to the exclusive jurisdiction of the Scottish courts. |
